Esta Carta Circular se adopta en virtud de los poderes conferidos en la Sección 9 de la Ley Orgánica del Departamento del Trabajo y Recursos Humanos, Ley Núm. 15 de 14 de abril de 1931, según enmendada, la cual establece que el Departamento del Trabajo y Recursos Humanos (DTRH) tendrá a su cargo la responsabilidad y autoridad para fiscalizar, supervisar y poner en vigor las disposiciones de toda ley estatal o federal, y las normas de seguridad y salud ocupacionales, reglas, reglamentos y órdenes promulgadas bajo la legislación aplicable. Esta política pública tiene el objetivo de garantizarle, tanto como sea posible, a cada empleado, condiciones de trabajo seguras y saludables para preservar nuestros recursos humanos.

a Residentes de Puerto Rico bajo el "Coronavirus Aid, Relief, and Economic Security Act" (CARES ACT)

La ley federal conocida como el Coronavirus Aid, Relief, and Economic Security Act ("CARES Act"), aprobada el 27 de marzo de 2020 provee para el Pago de Impacto Económico a ciertos individuos elegibles durante el transcurso del año 2020 ("Pago"). Basado en los lineamientos esbozados por el Servicio de Rentas Internas federal ("IRS", por sus siglas en inglés), el Departamento de Hacienda ("Departamento") emite estas guías con el propósito de atender las interrogantes más frecuentes surgidas a raíz de dicha legislación.

El Departamento emitirá los Pagos tan pronto el Tesoro Federal transfiera los fondos correspondientes al Gobierno de Puerto Rico, según se establece en el Plan de Distribución aprobado el 1 de mayo de 2020 por el Tesoro Federal. La información aquí provista será actualizada periódicamente para revisar respuestas y añadir preguntas adicionales.

EPA Announces $300,000 a Brownfields Grant
for Toa Alta, Puerto Rico



NEW YORK - Today, the U.S. Environmental Protection Agency (EPA) is announcing that Toa Alta, Puerto Rico was selected to receive $300,000 to assess and clean up contaminated properties under the agency's Brownfields Program. Under President Trump's Administration, EPA has delivered approximately $287 million in Brownfield grants directly to communities and nonprofits for cleanup and redevelopment, job creation, and economic development through the award of over 948 grants. EPA Regional Administrator Pete Lopez announced the grant with Toa Alta Mayor Augosto Clemente and Congresswoman Jenniffer Gonzalez-Colon.

Small Businesses Turn to Paycheck Protection Program and Innovation to Survive

 
The survey of 500 business owners was conducted April 21-27 and paints the stark economic reality of COVID-19. Almost one-in-three businesses are temporarily closed, up from 24% in the prior month, and more than one-in-five small businesses are two months or less from shutting down permanently. 

The poll shows that small businesses are facing a cash crisis. For the first time in the survey's history, less than half of small business owners (48%) are okay with their current cash flow situation. 

Many small businesses are turning to the  Paycheck Protection Program (PPP) for a cash flow solution. One-third (32%) of small businesses applied for a PPP loan, and 13% report they are planning on applying. Interestingly, when asked about the importance of a PPP loan to keep their business open, small businesses are split: 47% report that PPP loans are critical, and 46% say they are not.

In addition to looking for cures for the cash flow ailment, small business owners are increasingly innovating their way through the pandemic. The poll reports 20% of small businesses transitioning some or all of their employees to teleworking, up 8 percentage points from the previous month. And, 17% have transitioned their retail presence to be more virtual or digital, up 7 percentage points from the end of March.

Flags of Valor (FOV), in Ashburn, VA, is a good example. Experiencing a loss of two-thirds of their revenue in March, the company was forced to furlough half their team.  Co-Founder and owner, Joe Shamess, recently was approved for a PPP loan after missing out on the first round of PPP funding (the original $349 billion in PPP loans ran out on April 16th). He is hiring back all of the combat-injured veterans who manufacture the sourced-in-America wooden flags and is bolstering the salaries of his skeleton crew who remained and experienced 50% pay cuts.

The additional liquidity provided by a PPP loan will help and so will creativity.  FOV realized that patriotism, a key customer attribute, is alive and well in the midst of the coronavirus crisis.  Why not continue to align FOV's mission with patriotism while satisfying the needs of families to enjoy quarantine-at-home craft projects? And so, FOV's Flag Build Kit  was born.

First Look: Interactive State-By-State Map on Reopening Guidelines

Tomorrow, the U.S. Chamber will release an interactive map with state-specific information to help business owners distill and navigate different state-based public health guidelines as they begin to reopen in communities across the nation. 

This resource is a one-stop-shop for businesses as they navigate general guidance issued by states as well as sector-specific guidelines for retailers, restaurants and bars, childcare facilities, and other industries. It joins a growing list of resources available to American workers and businesses from the Chamber.

Service Sector Fell Sharply in April

Unsurprisingly, the  ISM Non-Manufacturing Index for April shows the services sector of the economy dropped precipitously.

Prior to the COVID-19 shock, services were driving growth, as manufacturing was in a slump. According to the index, services were still growing through March when it registered 52.5. A reading above 50 in the ISM index signifies growth. That is a testament to how well the economy was doing until a few short weeks ago that services were still growing through a half-month shutdown.

But no sector of the economy can withstand the Great Pause. The index fell almost 11 points to 41.8 in April, which is strongly in contractionary territory and the lowest mark since March 2009.

Sadly, the reading could've been even worse. The length of time for businesses to receive supplies increased, which is usually a sign of strong growth. In the current context it is emblematic of a shuttered economy.

With shutdowns beginning to ease across the country, there is hope this is a one-time aberration and May will show a strong rebound. This metric is a key one to watch as it will give us a sense of how much consumers are getting back to spending.

Majority Supports Protecting Employers from Coronavirus Lawsuits

The Chamber's Institute for Legal Reform released a poll Tuesday showing that Americans across the political spectrum believe that employers must have protections from COVID-related lawsuits as they make decisions about how to safely and sustainably reopen their businesses.

More than six-in-ten Americans say Congress should extend liability protections to employers. Specific protections show even higher support:    
  • 84% of Americans agree that essential businesses, like grocery stores and pharmacies, should be protected from coronavirus-related lawsuits.
     
  • 82% agree that, aside from cases of gross negligence, employers who follow public health guidelines to protect their customers should be shielded from lawsuits.
"The global pandemic has caused tremendous economic harm to our nation," said Harold Kim, president of the U.S. Chamber Institute for Legal Reform. "As employers plan to reopen safely and sustainably, the last thing they need is to face a financially crippling lawsuit despite their best effort to comply with public health guidelines."

ICYMI Chamber Executive Vice President and Chief Policy Officer Neil Bradley discussed liability protections on NPR this morning.

"We're not asking for some type of immunity, we're asking for a safe harbor," Bradley said. "No one wants to protect bad actors here, but businesses that are trying to do the right things shouldn't be second-guessed a year later in a court of law."

Los profesionales de la salud que tengan síntomas de COVID-19 o sospecha de haberse contagiado podrán acudir a las facilidades del Colegio de Médicos Cirujanos de Puerto Rico, lunes a viernes de 8:00am a 5:00pm, para realizarse la prueba diagnóstica rápida que los saque de dudas. 

El doctor Víctor Ramos, presidente del Colegio, informó que esta gestión se realiza en alianza con la Asociación de IPA's, la Cámara de Comercio de Puerto Rico, el Colegio de Enfermería Práctica y organizaciones aliadas a la salud. El servicio es libre de costo, los profesionales de la salud solo necesitan llevar una orden médica y sacar cita antes de ir.
